HRSDC Regulatory Initiatives 2008-2009


Regulations Planned Results
Labour
Wage Earner Protection Program (WEPP): Establishment of regulations begun in 2007 2008 will carry over into fiscal year 2008-2009.

Approval process: Completed regulations will be submitted to the Treasury Board for approval of pre-publication in Part I of the Canada Gazette. A public consultation phase will follow, then a return to TBS for final approval and publication in Part II of the Canada Gazette. All steps in this approval process are anticipated to occur in 2008-2009.

Other considerations: Payment of wages and unused vacation pay for workers whose employers go into bankruptcy or receivership, which will be done through the WEPP, represents a new area of activity for the federal government.

Impact: Medium-high

The regulations developed will specify certain conditions of eligibility for the WEPP, clarify certain definitions including the wages protected under the Wage Earner Protection Program Act, and establish other administrative details for the operation of the Program that are not explicitly spelled out in the Act. The WEPP cannot be implemented until the regulations take effect.
Occupational Health and Safety Regulations (COHSR)- Part XX -Violence in the Workplace To be published in Part II of the Canada Gazette. This is a medium impact regulatory initiative. This will fulfill the Labour Program's obligation to make regulations prescribing steps to prevent and protect against violence in the workplace.
Aviation Occupational Health and Safety Regulations - working in concert with Transport Canada to amend the existing regulations. To be published in Part II of the Canada Gazette. This is a medium impact regulatory initiative. This will bring the existing regulations up to date with the Canada Occupational Health and Safety Regulations (COHSR) and with the current standards and work practices in the aviation industry.
Maritime Occupational Health and Safety Regulations - working in concert with Transport Canada to amend the existing regulations. To be prepublished in Part I of the Canada Gazette. This is a medium impact regulatory initiative. This will bring the existing regulations up to date with the Canada Occupational Health and Safety Regulations (COHSR) and with the current standards and work practices in the marine industry in Canada, as well as bring them in line with requirements of international marine conventions.
Canada Occupational Health and Safety Regulations (COHSR) - Part VI - Levels of Lighting. To be pre-published in Part I of the Canada Gazette. This is a medium impact regulatory initiative. This amendment will bring the existing Part VI in line with the current standards required for the air traffic control industry.
Donkin Coal Block Regulations To be published in Part II of the Canada Gazette. This is a low impact regulatory initiative. The proposed regulations will exclude federal labour laws from application at the Donkin mine and incorporate provincial labour laws by reference into the Canada Labour Code.
Point Lepreau Generating Station Exclusion from Part I, Part II, and Part III of the Canada Labour Code To be prepublished in Part I of the Canada Gazette. This is a low impact regulatory initiative. Each of the proposed regulations will exclude federal labour laws from application, refer to the equivalent New Brunswick legislation and incorporate these provisions into the Canada Labour Code.
Income Security and Social Development
The Canada Disability Savings Regulations The purpose of the Canada Disability Savings Act is to encourage long term savings through registered disability savings plans to provide for the financial security of persons with severe and prolonged impairments in physical or mental functions. The Act was passed and received Royal Assent on December 14, 2007, but will only be brought into force in late 2008.

Regulations which specify the payment and repayment conditions for the Canada Disability Savings Grant and the Canada Disability Savings Bond are being developed.
Regulations to operationalize Bill C-36 amendments to the Canada Pension Plan and the Old Age Security Act. Bill C-36, which received Royal Assent on May 3, 2007, contained a number of legislative proposals intended to strengthen accountability and streamline the delivery of benefits under the Canada Pension Plan (CPP) and the Old Age Security Act (OAS).

The Department will develop a package of regulatory amendments designed to support the recent amendments to CPP and OAS. Examples of these amendments include, but are not limited to:
  • Amendments to facilitate electronic service delivery and transactions;
  • Amendments setting appropriate circumstances and conditions for the charging of interest on OAS and CPP program debts; and
  • Amendments to expand the group of third parties to whom a senior's personal information may be provided (upon written consent of the senior).
Other technical amendments to the CPP and OAS Regulations not associated with Bill C-36 will also be part of the C-36 package.
Skills and Employment
Regulatory and legislative initiatives required to address Employment Insurance policy and operational priorities will be undertaken as necessary. Any legislative and/or regulatory initiatives undertaken will strengthen and support the Employment Insurance program
Amendments to the Immigration and Refugee Protection Regulations, in collaboration with Citizenship and Immigration Canada, will be undertaken to strengthen program integrity and to put in place employer monitoring and compliance measures. Strengthen Temporary Foreign Worker Program integrity and support improved protection for temporary foreign workers.
Canada Student Loans
Changes to the Canada Student Loans Regulations (CSLR) and the Canada Student Financial Assistance Regulations (CSFAR), as required to implement initiatives announced in Budget 2008. The changes to the CSLR and the CSFAR are needed to implement most of the initiatives announced in Budget 2008. Other amendments are intended to simplify and modernize the regulatory framework of the CSLP; thus resolving outstanding challenges and irritants; allowing for innovation; enhancing the accountability and integrity of the CSLP; and correcting technical inconsistencies.
