Commencing in the 2009-10 Estimates cycle, the NEB’s single program activity, Energy Regulation and Advice, was split into two major programs: Energy Regulation and Energy Information. As well, Internal Services is displayed separately from other program activities; they are no longer distributed among the remaining program activities, as was the case in previous years. Actual totals for 2008-09 reflect the previous Program Activity Architecture.

Other Information: Under the COGO Act, the NEB regulates oil and gas activities on Frontier lands not subject to a federal/provincial accord.

Performance Results: 30 requests were completed in 2010-11. 35 requests were received during the reporting period and 5 requests were carried forward from the previous period. 10 requests were carried forward into 2011-12. 24 requests (69 per cent) were completed in 30 days or a notice of extension was sent within 30 days. 4 requests were completed in 31-60 days and 6 requests were completed in 61-120 days.

Other Information: The number of Access to Information Act requests received by the NEB increased considerably in 2010-11. This unprecedented number of requests affected performance results. To address this, the NEB assigned additional resources through internal reallocation and developed new tools during the year.


Note: According to prevailing legal opinion, where the corresponding fee introduction or most recent modification occurred prior to March 31, 2004:

  • the performance standard, if provided, would not have received parliamentary review; and
  • the performance standard, if provided, may not respect all established requirements under the UFA (e.g., international comparison or independent complaint address); and
  • the performance result, if provided, is not legally subject to section 5.1 of the UFA regarding fee reductions for unachieved performance.

The NEB’s COGO Act service standards are reviewed with stakeholders on an opportunity basis at meetings with companies, organizations (such as the Canadian Association of Petroleum Producers), and at other venues (such as the Annual Oil and Gas Forum).

Consultations with stakeholders were undertaken by the Department of Justice and the Treasury Board Secretariat for amendments done in 1986 and 1992.

Response to Parliamentary Committees and External Audits


Response to Parliamentary Committees
  • The Senate Standing Committee on Energy, the Environment and Natural Resources tabled its interim report Attention Canada! Preparing for our Energy Future on 29 June 2010.
    • No recommendations received.
  • The Senate Standing Committee on Energy, the Environment and Natural Resources tabled its report Facts Do Not Justify Banning Canada’s Current Offshore Drilling Operations: A Senate Review In the Wake of BP's Deepwater Horizon Incident on 18 August 2010.
    • The report examined the current status of Canada’s offshore oil and gas exploration and development industry, including the nature of the applicable regulatory regime(s) and Canada’s present offshore disaster response capability. The committee made six recommendations.
    • The NEB did not table a Government Response, but is addressing Recommendations 3, 5 and 6 in an Arctic context through its Arctic Offshore Drilling Review. With respect to Recommendation 4, the NEB works with other regulators and agencies on an ongoing basis to improve the prevention of and response to oil spills. Recommendations 1 and 2 do not require action from the Board at this time.
