Regulations (2008-2009) Expected Results
Amendment to the Gasoline Regulations (competition vehicles)

 

The proposed amendment will possibly extend the lead exemption for competition vehicles. The exemption for competition vehicles expires on December 31, 2007. A triage questionnaire will be available after an economic study is completed. Performance measures will continue reporting of volumes of leaded gasoline produced, imported and sold as per the current requirements under the Regulation.

Prescribing circumstances for a waiver for fuels regulations made under Division 4 (Fuels) of CEPA 1999 Allows the Minister the option to waive fuel regulations once the prescribed circumstance has been met.

Amendment to the Off-Road Small Spark-Ignition Engine Emission Regulations This amendment will incorporate emission standards for large spark-ignition engines (over 19 kW) in alignment with U.S. Environmental Protection Agency regulations for off-road gasoline-fuelled engines such as those found in forklifts and ice resurfacers.

Export Control List Regulations These regulations will merge the existing Export of Substances Under the Rotterdam Convention Regulations and the Export Control List Notification Regulations. The regulations will reflect the coming into force of the Rotterdam Convention and improve the efficiency of the process to add a chemical to the Convention under the Regulations.

Renewable Fuels Regulations The Government intends to develop and implement a federal regulation requiring renewable fuels. The regulation, to be developed under the Canadian Environmental Protection Act, 1999 (CEPA 1999), as may be amended by Canada's Clean Air Act, would require fuel producers and importers to have an average annual renewable fuel content of at least 5 percent of the volume of gasoline that they produce or import, commencing in 2010.

Marine Spark-Ignition Engine and Off-Road Recreational Vehicle Emission Regulations New regulations to establish in Canada emission standards for outboard engines, personal watercraft, snowmobiles, off-road motorcycles and all-terrain vehicles. These regulations will align standards for smog-forming emissions with those of the U.S. and set stringent emissions limits for nitrogen oxides, hydrocarbons and carbon monoxide.

Amendment to the Off-Road Compression-Ignition Engine Emission Regulations This amendment will establish more stringent "Tier 4" emission standards for diesel engines used in construction, agriculture, mining and forestry equipment. These planned amendments will maintain alignment with the emission standards of the U.S. and will reduce allowable emission levels for particulate matter, nitrogen oxides and hydrocarbons.

Revisions to the Ozone-Depleting Substances Regulations, 1998 To ensure that Canada fulfils its international obligations, these revisions will reflect a recent legally binding adjustment to the phase-out schedule for the consumption of hydrochlorofluorocarbons (HCFCs) and the introduction of controls measures for the production of HCFCs under the Montreal Protocol. Revisions will also serve to consolidate the Ozone-Depleting Substances Regulations, 1998 and its subsequent amendments.

Clean Air Industrial Regulations This new regulation will set targets for emissions of air pollutants and greenhouse gasses from the main industrial sectors in Canada. This regulation will also specify compliance mechanisms and quantification and reporting rules.

The Regulatory Framework for Air Pollutant Emissions will be finalized by spring 2008, and the Regulatory Framework for Greenhouse Gas Emissions before that. The Regulation would come into force in 2010. The greenhouse gas targets would come into effect in 2010, and the air pollutant targets, in 2015.

CCME Canada-wide Strategy for the Management of Municipal Wastewater Effluents The objective of this CCME Canada-wide strategy is to harmonize the regulatory framework by defining the roles and responsibilities of all jurisdictions and establishing agreed-upon national performance standards (baseline) and implementation timelines for effluent quality.

Wastewater Effluent Regulations under the Fisheries Act and CEPA 1999 New regulations under the Fisheries Act to ensure that releases of wastewater effluent from municipal and other publicly owned wastewater systems do not pose unacceptable risks to human and ecosystem health or fisheries resources.

Amendments to the Export and Import of Hazardous Waste and Hazardous Recyclable Material Regulations These amendments will incorporate provisions for the export, import and transit of non-hazardous waste destined for final disposal. This regulatory framework is being developed to protect the environment from risks posed by the uncontrolled export, import and transit of non-hazardous wastes destined for final disposal. Consistent with Canada's international obligations, the regulatory framework would control the export from and import into Canada of these wastes. The proposed regulatory framework will include mechanisms for notification and prior informed consent, and tracking.

Polychlorinated Biphenyl (PCB) Regulations Provide a more effective and comprehensive framework for ending the use and storage of PCBs within specified timelines. Establish reporting and monitoring requirements to measure progress. Ensure Canada is in line with its international commitments and obligations.

Mercury in Products Regulations To prohibit all mercury in products with some exemptions. The Regulations will also set mercury limits for some products where alternatives are not available.

Interprovincial Movement of Hazardous Waste and Hazardous Recyclable Materials Regulations

 

Amendment required to ensure coherence among relevant federal regulations regarding the definitions of hazardous waste and hazardous recyclable material and the new movement document, which is maintained to track the movements of hazardous waste and hazardous recyclable material.

Amendment to Schedule 1 of CEPA 1999 for 3,3'- Dichlorobenzidine. 3,3'-Dichlorobenzidine (3,3'-DCB) was added to the List of Toxic Substances under Schedule 1 of CEPA 1999 on November 13, 1999. However, at that time, the phrase "and its salts" was not included. The proposed order to amend to the Schedule 1 listing will enable Environment Canada to implement management measures to address the risks associated with 3,3'-DCB salts (i.e. to proceed with the proposed pollution prevention notice).

Amendments to the Pulp and Paper Effluent Regulations under the Fisheries Act Finalize amendments to the Environmental Effects Monitoring (EEM) Program to further target monitoring efforts and resources where they are needed most. Amendments would incorporate opportunities for program improvements identified through departmental implementation experience and a recent multi-stakeholder smart regulation project on EEM.

Miscellaneous amendment to the Disposal at Sea Regulations This amendment will address two issues: comments by the Standing Joint Committee for the Scutiny of Regulations, and the correction of out-of-date administrative information.

Volatile Organic Compound (VOC) Concentration Limits for Architectural Paints Regulations These new regulations will implement national VOC concentration standards for categories of paints and coatings. They will align with existing requirements in the U.S. to reduce air emissions of VOC, which are precursor pollutants contributing to the formation of ground-level ozone and particulate matter.

Amendments to the Migratory Birds Regulations under the Migratory Birds Convention Act, 1994 Draft provisions for incidental take. These provisions ensure effective conservation of migratory bird populations while promoting sustainable economic development.

Challenge under the Chemicals Management Plan The plan announced rapid regulatory action over the 2007-2011 period on 200 substances believed to be harmful to human health or the environment. The Government is predisposed to prohibit activities for these substances unless stakeholders come forward with information indicating the substances are already used in a way that safeguards Canadians and the environment. Until the end of 2009, batches of 15 to 30 substances will be launched every three months. For the 200 substances, the Government
  • will publish results of risk assessments in the Canada Gazette, Part I (2008-2011);
  • will publish notices under section 71 of CEPA 1999 in the Canada Gazette, Part 1 (2007-2009);
  • may publish orders adding substances to Schedule 1 of CEPA 1999 in the Canada Gazette, Parts I and II (2008-2011);
  • may publish, in the Canada Gazette, Parts I and II (2008-2011), notices of intent and orders to amend the Domestic Substances List by adding indications that the Significant New Activity provision applies to the substances;and
  • will publish preventive or control instruments in the Canada Gazette, Parts I and II (2008-2011).
Release Notification Regulations The proposed Release Notification Regulations under CEPA 1999 would ensure that, in the event of a release of a substance in contravention of the applicable regulations or in the event of an environmental emergency, the regulated community is provided with the twenty-four hours a day, seven days a week (24/7) emergency telephone number of each province and territory in the regulations.

These regulations are expected to be published during the second quarter of 2008 in the Canada Gazette, Part I.

Deposits out of the Normal Course of Events Reporting Regulations The proposed Deposits out of the Normal Course of Events Reporting Regulations under the Fisheries Act would ensure that, in the event of a deposit of a deleterious substance out of the normal course of events, the regulated community is provided with the twenty-four hours a day, seven days a week (24/7) emergency telephone number of each province and territory in the regulations.

These regulations are expected to be published during the second quarter of 2008 in the Canada Gazette, Part I.

Regulations (2009-2010) Expected Results
Amendments to the New Substances Notification Regulations (Organisms) Provide a more efficient, enforceable, fair and clear notification scheme for new organisms other than micro-organisms (e.g. transgenic animals) intended for import or manufacture (including for research purposes) in Canada, while maintaining or improving the safeguard of the environment and human health (pollution prevention).

Publish in the Canada Gazette, Part I, 2009-2010.

Regulations Limiting Polybrominated Diphenyl Ethers (PBDE) in Manufactured Articles and Products (draft name) These new regulations will complement the Polybrominated Diphenyl Ether Regulations that were published in the Canada Gazette, Part I, in December 2006, which prohibited the manufacture, sale, use and import of certain PBDEs in commercial mixtures, polymers and resins. The new proposed Regulations Limiting PBDEs in Manufactured Articles and Products will control concentrations of PBDEs in manufactured articles and products. They will align to an extent with existing requirements in the U.S. and European Union.
