1. Terms and definitions

The following words and phrases used in this section have the same meaning as the ones in the Glossary of terms and definitions found under the Compensation and Pay Administration heading. In order to ensure consistency and accuracy in terminology, the user may click on any of these terms for the definition.

2. General

An employee holding a position for which there is a minimum and maximum rate of pay shall be granted pay increments until the maximum for that position is reached, except for employees of the Management Category and employees to whom any of the various performance pay plans apply. The rate of pay shall be the next higher rate in the scale of rates applicable to the position.

Where two or more pay actions are authorized with the same effective date, the sequence of processing to be applied is: pay increments, salary revisions, followed by promotions/deployments or transfer by appointment/demotions (PSTCER 27).

2.1 Wage restraint (increment freeze)

History

The introduction of Bill C-17, the Budget Implementation Act, 1994, which received Royal Assent on June 15, 1994, contained a freeze on pay increments for a two (2) year period, which is effective from June 15, 1994, to June 14, 1996, inclusive.

Any employee holding a position for which there was a minimum and maximum rate of pay and who was not yet at the maximum for the group and level, was not to be granted pay increments until the increment freeze was no longer in effect.

The freeze had no effect on the day and the month of the employee's pay increment dates.

 

Example 1: Pay increment date is the Monday following the pay increment period of 52 weeks

An employee was appointed to an AS-02 position at the minimum rate of pay, which is effective on Thursday, June 25, 1992. The employee's last pay increment before the freeze was effective on Monday, June 28, 1993. This was to the 2nd step of the AS-02 salary range.

The employee's subsequent pay increments would have been effective on:

  • Monday, June 27, 1994 (within the increment freeze period); and
  • Monday, June 26, 1995 (within the increment freeze period).

The employee's first increment after the increment freeze was effective on Monday, June 24, 1996, and the employee was entitled to the 3rd step of the AS-02 salary range.

 

Example 2: Pay increment date is the anniversary of appointment date

An employee was appointed to a CS-03 position at the minimum rate of pay effective Tuesday, June 23, 1992. The employee's last pay increment before the freeze was effective on Wednesday, June 23, 1993, to the 2nd step.

The employee's subsequent pay increments would have been effective on:

  • June 23, 1994 (within the increment freeze period); and
  • June 23, 1995 (within the increment freeze period).

The employee's first pay increment after the increment freeze was effective on Sunday, June 23, 1996, and the employee was entitled to the 3rd step of the CS-03 salary range.

 

Example 3: A part-time employee's pay increment date is the working day immediately following completion of having worked 1950 straight time hours

An employee was appointed to an AS-02 position at the minimum rate of pay effective on Tuesday, April 13, 1993. The employee's AWW was 30 hours a week, with Monday being the scheduled non-work day.

The employee's subsequent pay increments based on an AWW of 30 hours would have been effective on:

  • Tuesday, July 12, 1994 (within the increment freeze period); and
  • Tuesday, October 10, 1995 (within the increment freeze period).

The employee's first pay increment after the increment freeze was effective on Tuesday, January 7, 1997, and the employee was entitled to the 2nd step of the AS-02 salary range.

3. Effective date

Refer to the relevant collective agreement, pay plan or specific terms and conditions of employment for pay increment periods and effective dates.

When the relevant authority is silent, the pay increment period shall be 12 months (PSTCER 31) with the pay increment date being the first of January, April, July or October if appointed on that date or from the quarterly date following the date of appointment (PSTCER 32).

4. Determination of date

4.1 Initial appointment (PSTCER 32)

The first pay increment becomes due at the end of the period specified in the relevant collective agreement, pay plan or specific terms and conditions of employment and is calculated from the date of the employee's appointment.

Example 1

The PA collective agreement states that the pay increment date for AS levels 01 to 07 is the first Monday following the pay increment period of 52 weeks.

A full-time indeterminate employee appointed effective on Thursday, December 5, 2002, to an AS-02 position is entitled to receive the first pay increment effective on Monday, December 8, 2003. The second and subsequent pay increments in the AS-02 position are due on Monday at 52-week intervals calculated from the date on which the last increment was due.

 

Example 2

The EC collective agreement states that the pay increment period for the SI classification is 12 months, and the pay increment date shall be the anniversary date of the appointment.

A full-time indeterminate employee who was appointed, effective on Friday, November 8, 2002, to a SI-02 position would be entitled to a pay increment, which is effective Saturday, November 8, 2003. All subsequent pay increments in the SI-02 position would be effective on November 8 of each year.

4.2 On promotion (PSTCER 32)

A new pay increment date is established where the employee is entitled, upon promotion, to a rate of pay, which is less than the maximum for the occupational group and level to which the employee is promoted.

Example

A full-time employee in a GT-07 position who is earning $74,759 per annum is promoted to a represented AS-07 position, which is effective on February 10, 2003.

The employee's salary on promotion, which is effective on February 10, 2003, is $77,456. This is the 3rd step in the represented AS-07 salary scale.

The PA collective agreement states that the pay increment date for AS levels 01 to 07 is on the first Monday following the pay increment period of 52 weeks.

The employee's next pay increment in the represented AS-07 level is effective on the first Monday, following the pay increment period of 52 weeks, which is Monday, February 9, 2004.

4.3 On deployment or transfer by appointment (PSTCER 33.(1) to 39)

Upon a deployment or a transfer by appointment to a position, which has the same pay increment period as the former position, the first pay increment shall become due at the end of the pay increment period, which is calculated from the date it would have been calculated in the former position (PSTCER 33.(1)).

Upon a deployment or a transfer by appointment from a position where the employee is performing the duties of a seasonal nature to a regular position, the period already accumulated during the season will be considered in determining the period left to complete for the pay increment period of the new position (PSTCER 33.(2)).

Upon a deployment or a transfer by appointment from a position with a shorter pay increment period (for example, semi-annual) to a position with a longer pay increment period (for example, annual), the first pay increment shall be calculated from the date from which the employee's last pay increment period would have been calculated in the former position if the employee had continued in that position (PSTCER 34).

Upon a deployment or a transfer by appointment from a position with a longer pay increment period (for example, annual) to a position with a shorter pay increment period (for example, semi-annual), the first pay increment would become due one (1) year from the last pay increment, or after six (6) months in the new position, whichever is earlier (PSTCER 35).

When deployed or transferred by appointment during a probationary period, an employee retains the same pay increment date as that of the former position (PSTCER 39).

Subsequent pay increments, after the first pay increment that the employee received in the new position, shall become due at the end of the pay increment period for that position, which is calculated from the date on which the last pay increment in that position became due (PSTCER 38).

Example 1: Same pay increment period as the former position

A full-time indeterminate employee in a ST-SCY-03 position who is earning $36,711 2nd step per annum, which is effective on Monday, October 21, 2002, (last pay increment) is appointed to a CR-04 position, which is effective on Monday, April 14, 2003. Since this appointment is a deployment or transfer by appointment, the employee's salary on appointment, which is effective on Monday, April 14, 2003, is $37,421. This is the 2nd step of the CR-04 salary scale, which is the rate of pay nearest to but not less than the rate of pay received immediately prior to the appointment.

The PA collective agreement states that the pay increment dates for the ST-SCY-01 8th step and above, to the ST-SCY-04 and for the CR classifications are effective on the first Monday following the pay increment period of 52 weeks.

The employee's first pay increment as a CR-04 is effective on Monday, October 20, 2003, which is 52 weeks following the effective date of the last increment. The employee is entitled to be paid at the 3rd step, which is $38,387. The subsequent and final pay increment to the maximum is due effective on Monday, October 18, 2004.

 

Example 2: From a seasonal position to a regular position

An employee was appointed to a represented PM-03 position for a season that consists of seven (7) months each year, starting in 2001 for the period from April 2, 2001, to October 31, 2001, which totals 30 weeks and three (3) calendar days.

The off-season is from November 1, 2001, to March 31, 2002.

During the off-season, the employee is deployed to a full-time regular represented AS-03 position, which is effective on December 3, 2001.

The employee had already accumulated a total of 30 weeks and three (3) calendar days towards the next pay increment date.

Since the pay increment period for the AS-03 and the PM-03 is the same, the employee must complete 21 weeks and four (4) calendar days in the new position to be entitled to a pay increment, which is effective on the Monday following the completion of 52 weeks.

The employee's first pay increment in the new position will be effective on Monday, May 6, 2002. The subsequent and final pay increment to the maximum is due effective on Monday, May 5, 2003.

 

Example 3: From a represented position to an excluded position

A full-time indeterminate employee in a PM-06 (represented) position who is earning $77,456 per annum received the last pay increment to the 3rd step, which is effective on Monday, October 21, 2002. The employee is appointed to an AS-07 excluded position, which is effective on Monday, September 29, 2003. The employee's certificate of appointment is dated August 27, 2003.

Since this appointment is a deployment or transfer by appointment, the employee's salary on appointment, which is effective on Monday, September 29, 2003, is $77,456. This is within the AS-07 performance pay range, and it is also equivalent to the 4th step of the represented AS-07 salary scale. The salary rate of $77,456 is the rate of pay, which is nearest to but not less than the rate of pay received immediately prior to the appointment.

The PA collective agreement states that the pay increment date for the PM-06 classification is effective on the first Monday following the pay increment period of 52 weeks.

Appendix A of the Performance Pay Administration Policy for Certain Non-Management Category Senior Excluded Levels states that the in-range increase for an employee occupying an AS-07 excluded position is administered on April 1 of each year, or on a date prescribed by the Treasury Board. Furthermore, under no circumstances should an in-range performance increase be authorized for an employee whose performance has been assessed as "unsatisfactory."

The employee's first pay increment as an employee occupying an AS-07 excluded position will be made in accordance with the Performance Pay Administration Policy for Certain Non-Management Category Senior Excluded Levels, and if all of the criteria are meet will be effective on April 1, 2004.

 

Example 4: From a shorter pay increment period to a longer pay increment period

The last increment of a full-time indeterminate DA-CON-01 employee is effective Monday, January 13, 2003. The salary is $27,819 and is the 5th step. The employee is appointed to a CR-02 position, which is effective on Monday, April 28, 2003.

Since this appointment is a deployment or transfer by appointment, the employee's salary on appointment, which is effective on Monday, April 28, 2003, is $29,008. This is the minimum of the CR-02 salary scale, which is the rate of pay nearest to but not less than the rate of pay received immediately prior to the appointment.

The PA collective agreement states that the pay increment date for steps 1 to 8 inclusive of the DA-CON-01 classification is effective on the first Monday following the pay increment period of 26 weeks. The pay increment date for the CR classification is effective on the first Monday following the pay increment period of 52 weeks.

The employee's first pay increment as a CR-02 is effective on the Monday following the pay increment period of 52 weeks and calculated on the employee's last pay increment date, which was January 13, 2003. The employee's subsequent pay increment date is Monday, January 12, 2004.

 

Example 5: From a longer pay increment period to a shorter pay increment period

Effective March 20, 2003, a full-time indeterminate employee was granted an increment to the 2nd step in a represented ES-01 position. The employee's salary is $39,066 per annum. The employee is appointed to a represented MA-01 position, which is effective April 28, 2003.

Since this appointment is a deployment or a transfer by appointment, the employee's salary on appointment, which is effective on Monday, April 28, 2003, is $39,066. This is the rate of pay that is nearest to but not less than the rate of pay received immediately prior to the appointment and is within the MA-01 salary range.

The EC collective agreement states that the pay increment period for the ES classification is 12 months, and the pay increment date shall be the anniversary date of the appointment.

The RE collective agreement states that the pay increment period for an MA-01 classification is six (6) months.

The employee's first pay increment in the new classification of the represented MA-01 will be effective within six (6) months following the employee's last pay increment date of the previous classification of the ES-01, which is on March 20, 2003. The employee's subsequent pay increment date will be effective on Saturday, September 20, 2003.

 

Example 6: During a probationary period

Effective February 13, 2003, a person who is appointed from outside the Public Service to a represented DA-CON-01 position is being paid $24,998, the minimum. The employee is subject to a probationary period, which ends on February 12, 2004.

The employee's first pay increment date in the DA-CON-01 position is scheduled for Monday, August 18, 2003.

In the interim, the employee is appointed to a represented CR-02 position, which is effective on April 28, 2003, at a salary of $29,008 (minimum). The employee's certificate of appointment is dated on March 20, 2003.

Since the appointment is a deployment or a transfer by appointment during a probationary period, the employee maintains the increment period of the initial appointment to the DA-CON-01 position.

The PA collective agreement states that the pay increment period for the DA-CON-01 classification, steps 1 to 8 inclusive, is effective on the first Monday following the pay increment period of 26 weeks. The PA collective agreement states that the pay increment period for the CR classification is effective the first Monday following the pay increment period of 52 weeks.

The employee's first pay increment in the represented CR-02 position is effective on Monday, August 18, 2003, following the pay increment period of 26 weeks based on the employee's previous classification of DA-CON-01, due to the probationary period which is still in effect.

The employee's subsequent increment date in the CR-02 classification will be effective on Monday, August 16, 2004.

4.4 On demotion (PSTCER 32)

A new pay increment date is established on demotion.

Example

This refers to an employee occupying a represented CR-04 position who is earning $37,421, which is the 2nd step in the salary scale.

Effective on April 23, 2003, the employee is demoted to a represented ST-SCY-03 position.

The employee's salary on the demotion as of April 23, 2003, is $36,711. This is the 2nd step of the ST-SCY-03 pay rate scale, which is the rate of pay that is nearest to but not more than the rate of pay received immediately prior to the demotion.

The PA collective agreement states that the pay increment period for the ST-SCY classification is effective on the first Monday following the pay increment period of 52 weeks.

The employee's next pay increment date in the represented ST-SCY-03 position is effective on Monday, April 26, 2004.

4.5 Leave without pay

Unless otherwise provided in the relevant collective agreement, pay plans or specific terms and conditions of employment, pay increments are not affected by periods of leave without pay (PSTCER 43).

Where the leave without pay affects a pay increment, the pay increment shall become due on the date the employee will have completed a period of employment equal to the pay increment period, as specified for the position (PSTCER 44).

Where an increment date is affected by leave without pay, all eligible periods before and after the affected absence, starting from the last pay increment date are counted towards the next increment date.

Example 1: Maternity leave without pay

This refers to a full-time indeterminate employee who receives a pay increment in a represented CS-02 position, which is effective on Tuesday, August 13, 2002.

Since the pay increment period for the CS-02 is 12 months and the increment date is the anniversary date, the employee's next pay increment is effective on Wednesday, August 13, 2003.

The employee commences a maternity leave without pay, which is effective on Monday, July 14, 2003.

As per Article 17.03(C) of the CS collective agreement, which is signed on June 3, 2003, the time spent on such leave shall be counted for pay increment purposes.

The employee's pay increment date remains unchanged and is effective on Wednesday, August 13, 2003.

Note 1: The employee is entitled to an adjustment to the maternity allowance, taking into account the true effective pay increment date.

Note 2: Superannuation, supplementary death benefit and disability insurance deficiencies, if applicable, will also be based on the pay increment salary, which is effective on August 13, 2003.

 

Example 2: Leave without pay for the care of immediate family

This refers to a full-time indeterminate employee who receives a pay increment in a represented CS-02 position, which is effective on Tuesday, August 13, 2002.

Since the pay increment period for the CS-02 is 12 months and the increment date is the anniversary date, the employee's next pay increment is effective on Wednesday, August 13, 2003.

The employee begins a period of leave without pay for the care of their immediate family, which is effective from Monday, July 14, 2003, to Thursday, July 15, 2004, inclusive, a period of one (1) year and two (2) calendar days. Article 17.09(e) of the CS collective Agreement, which is signed on June 3, 2003, states that regardless of the length of the period of leave without pay, time spent on such leave shall not be counted for pay increment purposes.

The employee's next pay increment date will be postponed until such time as the employee has been remunerated for a total of 12 months.

The employee's pay increment date is effective on August 14, 2004, and all subsequent pay increments in the CS-02 position will be effective on August 14 of each year.

4.6 Denial of pay increment (PSTCER 40)

A deputy head may withhold a pay increment from an employee. When the deputy head declares that the employee is not performing the duties of the position satisfactorily, the intention of denying the pay increment shall be given to the employee in writing at least two (2) weeks and not more than six (6) weeks before the due date for the pay increment. When increments are denied, reference should also be made to the relevant collective agreement or pay plan to determine if this authority provides any specifics. For instance, the EL collective agreement states that when an increment is denied, the employer must review the employee's performance three (3) months after the date of denial and decide whether or not the employee's increment should be granted.

4.7 Subsequent to denial (PSTCER 41)

The reinstatement date for the pay increment may be:

  • On the first day of any month specified by the deputy head in writing, prior to the date on which the next pay increment would become due to the employee; or
  • On the day the pay increment would next become due, as if a denial had not occurred.

Example 1(a)

This refers to a full-time employee who is promoted to a represented SI-02 position, which is effective on June 18, 2002.

The EC collective agreement states that the pay increment period for the SI classification is 12 months, and the pay increment date shall be the anniversary date of the appointment. The employee's next pay increment date is effective on June 18, 2003.

Subsequent to the employee's performance review in March 2003, it was determined that the employee was not performing the duties of the position satisfactorily.

The deputy head must advise the employee in writing, of the intention of denying the scheduled pay increment.

The employee is given written notice on May 26, 2003, that the June 18, 2003, pay increment is denied and withheld until such time when the employee meets a satisfactory level of performance in the SI-02 position.

Example 1(b)

The employee in Example 1(a) is given written notice on May 26, 2003, that the June 18, 2003, pay increment in the SI-02 position is denied and withheld until such time when the employee meets a satisfactory level of performance. The employee was promoted in the represented SI-02 position, which is effective on June 18, 2002.

On September 10, 2003, the deputy head determines that the employee now meets the satisfactory requirements of the SI-02 position and determines that the pay increment can be granted on October 2003. The employee's pay increment date is October 1, 2003.

The employee's next pay increment will be effective June 18, 2004. The employee maintains the anniversary date of the promotion despite the withholding of the June 18, 2003, pay increment.

 

Example 1(c)

The employee in Example 1(a) is given written notice on May 26, 2003, that the June 18, 2003, pay increment in the SI-02 position is denied and withheld until such time as the employee meets a satisfactory level of performance. The employee was promoted in the represented SI-02 position, which is effective on June 18, 2002.

On September 10, 2003, the deputy head determines that the employee now meets the satisfactory requirements of the SI-02 position, but does not specify a month in which the employee is entitled to a pay increment.

The pay increment date is the next scheduled pay increment date of June 18, 2004. The employee maintains the anniversary date of the promotion, which is June 18, 2002, despite the withholding of the June 18, 2003, pay increment.

4.8 Second and subsequent denials

In accordance with the preceding section, if a subsequent increment date is not specified, it becomes due on the normal date as if a denial had not occurred. If on this date, a deputy head is satisfied that the employee is not performing the duties of the position satisfactorily, then the intention of denying the pay increment shall be given to the employee in writing at least two (2) weeks and not more than six (6) weeks before the due date of the pay increment.

Example 1(a)

This refers to a full-time employee who is promoted to a represented SI-02 position, which is effective on June 18, 2002.

The EC collective agreement states that the pay increment period for the SI classification is 12 months, and the pay increment date shall be the anniversary date of the appointment. The employee's next pay increment date is scheduled for June 18, 2003.

Subsequent to the employee performance review in March 2003, it was determined that the employee did not perform the duties of the position satisfactorily.

The deputy head must advise the employee in writing, in the time prescribed as per the PSTCER 40, which is at least two (2) weeks and not more than six (6) weeks before the due date of the pay increment of the intention of denying the scheduled pay increment.

The employee is given written notice on May 26, 2003, that the June 18, 2003, pay increment is denied and withheld until such time when the employee meets a satisfactory level of performance in the SI-02 position.

Unless otherwise specified, the reinstatement date for the next increment due is the normal date, as if a denial had not occurred.

Subsequent to the employee performance review in March 2004, it was determined that the employee did not perform the duties of the position satisfactorily.

The deputy head must advise the employee in writing, in the time prescribed as per the PSTCER 40, which is at least two (2) weeks and not more than six (6) weeks before the due date of the pay increment of the intention of denying the scheduled pay increment.

The employee is given written notice on May 10, 2004, that the June 18, 2004, pay increment is denied and withheld until such time as the employee meets a satisfactory level of performance in the SI-02 position.

Example 1(b)

The employee in Example 1(a) is given written notice on May 26, 2003, that the June 18, 2003, pay increment in the SI-02 position is denied and withheld until such time as the employee meets a satisfactory level of performance.

The employee is given written notice on May 10, 2004, that the June 18, 2004, pay increment in the SI-02 position is denied and withheld until such time as the employee meets a satisfactory level of performance.

The employee is promoted in the represented SI-02 position, which is effective on June 18, 2002.

On September 8, 2004, the deputy head determines that the employee now meets the satisfactory requirements of the SI-02 position and determines the pay increment can be granted in October 2004. The employee's pay increment date is effective on October 1, 2004.

The employee's next pay increment is effective on June 18, 2005. The employee maintains the anniversary date of the promotion despite the withholding of the June 18, 2003, and June 18, 2004, pay increments.

 

Example 1(c)

The employee in Example 1(a) is given written notice on May 26, 2003, that the June 18, 2003, pay increment in the SI-02 position is denied and withheld until such time as the employee meets a satisfactory level of performance.

The employee is again given written notice on May 10 2004, that the June 18, 2004, pay increment in the SI-02 position is denied and withheld until such time as the employee meets a satisfactory level of performance.

The employee is promoted in the represented SI-02 position, which is effective on June 18, 2002.

On September 8, 2004, the deputy head determines that the employee now meets the satisfactory requirements of the SI-02 position, but does not specify a month in which the employee is entitled to a pay increment.

The pay increment date is the next scheduled pay increment date of June 18, 2005. The employee maintains the anniversary date of the promotion, which is effective on June 18, 2002, despite the withholding of the June 18, 2003, and June 18 2004, pay increments.

4.9 Reappointment following lay-off (PSTCER 45)

Where a person entitled to a lay-off priority is reappointed within one year from the date of lay-off, and the reappointment following lay-off constitutes a deployment or transfer by appointment, the period from the last pay increment date to the date of lay-off is counted when determining the new pay increment date.

If the reappointment constitutes a promotion, a new pay increment date is established from the date of reappointment.

Example 1: Reappointment following lay-off - deployment or transfer by appointment

This refers to a full-time employee who is taken on strength, which is effective on June 11, 1990, was laid off from a represented SI-03 position, which is effective on August 4, 2000.

Example 2: Reappointment following lay-off - promotion

This refers to a full-time employee who is taken on strength, which is effective on June 11, 1990, was laid off from a represented CR-04 position, which is effective on August 4, 2000.

The employee's salary on the last day of employment was $35,514. This is the 2nd step of the CR-04 classification. The employee's latest pay increment was effective on February 14, 2000.

The employee is reappointed under PSEA 29(3) as a full-time AS-01, which is effective on July 9, 2001, at the minimum rate of pay of $36,733.

Since the reappointment constitutes a promotion, the next pay increment date is established from the date of reappointment. The employee's pay increment date is based on the July 9, 2001, and is effective on the first Monday following the pay increment period of 52 weeks.

4.10 Revisions

Where a pay increment and a pay revision are effective on the same date, the pay increment shall be applied first, and the resulting rate shall be revised in accordance with the pay revision.

4.11 Employees occupying a managerial or confidential position

Except for employees subject to performance pay plans, excluded employees who are classified in an occupational group and level covered by a collective agreement shall receive pay increments on the dates stipulated by the relevant collective agreement.

Note: An employee occupying a position under the PSTCER, Annex A, shall receive a pay increment as stipulated in the Performance Pay Administration Policy for Certain Non-Management Category Senior Excluded Levels.

4.12 Part-time employees

The method of calculating pay increments for part-time employees varies from one collective agreement to another. During the past few years, the provision for the qualifying period in some collective agreements was changed to match the qualifying period for a full-time employee.

Therefore, a reference must be made to the relevant collective agreement, pay plan or specific terms and conditions of employment to determine the method of calculating the pay increment period and the effective date.

If the collective agreement, pay plan or specific terms and conditions of employment is silent, the pay increment period shall be that period over which the part-time employee has been paid for the same number of straight-time hours as required by a full-time employee.

When referencing the different collective agreements, emphasis must be placed on the wording. For example, some collective agreements state that a part-time employee must work 1950 hours at the straight-time rate before being eligible for an increment.

The following are not included:

  • Overtime hours;
  • Leave without pay; and
  • Designated paid holidays.

However, additional hours paid at the straight-time rate (i.e. entitlement code 049) are counted when determining the pay increment due date.

Note: As per the relevant collective agreement, pay plan or the specific terms and conditions of employment, a part-time employee shall not be paid for the designated holidays, but shall instead be paid a premium for all straight-time hours worked during the period of part-time employment. The premium in respect of designated holidays should not be construed as meaning that the employees are being paid for the designated holidays.

Where the period of employment consists of both full-time and part-time employment, the pay increment period shall be calculated as per the relevant collective agreement, pay plan or specific terms and conditions of employment.

Example 1: Pay increment period same for both a full-time and a part-time employee

A full-time employee in a represented AS-01 position is appointed to a represented AS-02 position, which is effective on February 10, 2003.

The employee's assigned work week (AWW) as of February 10, 2003, is 22.50 hours a week.

The PA collective agreement states that the pay increment period for full-time and part-time employees for the AS classification is effective on the first Monday following the pay increment period of 52 weeks.

The employee's next pay increment in the represented AS-02 is effective on the Monday following the pay increment period of 52 weeks, which is on February 9, 2004.

 

Example 2: Pay increment period specific for a part-time employee with periods of both full-time and part-time employment

A full-time employee in a represented SI-01 position is appointed to a represented SI-02 position, which is effective on February 13, 2003.

Effective August 11, 2003, the employee amends the AWW from 37.50 hours a week to 30 hours a week, with Monday as the day off. The employee works in Ontario and does not amend the AWW when a designated holiday occurs.

The EC collective agreement states a part-time employee shall be eligible to receive a pay increment when the employee has worked a total of 1950 hours at the hourly rate during a period of employment. The pay increment date shall be the 1st working day following completion of the hours specified.

Example 4: Transitional implementation of a pay increment period for a part-time employee

This refers to a part-time employee in a represented AS-02 position with an AWW of 22.50 hours a week, with Monday and Tuesday as the days off. The employee's last pay increment was effective on September 18, 2000.

The PA collective agreement signed on November 19, 2001, changes the pay increment period for part-time employees. As of November 19, 2001, the pay increment period for part-time and full-time employees is identical. The increment date is effective on the first Monday following the pay increment period of 52 weeks.

The part-time AS-02 employee on November 19, 2001, the date of signing of the PA collective agreement receives a pay increment defective on November 19, 2001, because up to this date the employee had worked more than 52 weeks.

The next pay increment date will be calculated from November 19, 2001.

 

Example 5: Pay increment period specific for a part-time employee

A part-time employee in a represented EL-04 position is appointed on October 7, 2003. The employee has an AWW of 26.25 hours a week, and works every Tuesday, Wednesday, Thursday and Friday morning.

The employee works in Ontario and does not amend the assigned work week when a designated holiday occurs.

The EL collective agreement states a part-time employee working half-time (˝) time, or more but less than full-time, shall be eligible to receive a pay increment when the employee has worked a total of 104 weeks. The pay increment date is effective on the 1st Monday following completion of the specified increment period.

As long as the employee continues to work half-time time or more but less than full-time, the employee shall be eligible to receive a pay increment, which is effective on the Monday following completion of working a total of 104 weeks. For example, effective on Monday, October 3, 2005.

The next and all subsequent increments are effective on the Monday following completion of having worked another 104 weeks. For example, on Monday, October 1, 2007

4.13 Seasonal employees

All periods during which the employee performed the duties of the position, or was on leave of absence with pay, are included in the calculation of the pay increment period.

Unless otherwise provided in the relevant collective agreement, pay plan or specific terms and conditions of employment, pay increments are not affected by periods of leave without pay.

Note: The off-season is not included in establishing the pay increment date.

Example 1: Seasonal - first Monday following the pay increment period of 52 weeks

Effective 2001, an employee is appointed to a PM-03 position for a season that consists of seven (7) months each year. The first season is from April 2, 2001, to October 31, 2001. This period is comprised of 30 weeks and three (3) calendar days.

The off-season is from November 1, 2001, to March 31, 2002.

The employee returns for the second season from April 1, 2002, to October 31, 2002. This period is comprised of 30 weeks and four (4) calendar days.

The PM-03 pay increment period is 52 weeks and the pay increment date is effective on the first Monday following the pay increment period. The employee must complete 21 weeks and four (4) calendar days in the second season to be entitled to a pay increment.

Using only the actual time remunerated during the seasons (April to October), the employee completes 21 weeks and four (4) calendar days on Thursday, August 29, 2002.

The employee's pay increment date is effective on the Monday following the pay increment period of 52 weeks, which is on September 2, 2002.

 

Example 2: Seasonal - 52 weeks, anniversary date

Effective 2001, an employee is appointed to a GT-03 position for a season that consists of seven (7) months each year. The first season is from April 2, 2001, to October 31, 2001. This period is comprised of 30 weeks and three (3) calendar days.

The off-season is from November 1, 2001, to March 31, 2002.

The employee returns for the second season from April 1, 2002, to October 31, 2002. This season is comprised of 30 weeks and four (4) calendar days.

The pay increment period for the GT-03 is 52 weeks and the pay increment date is the anniversary date. The employee must complete 21 weeks and four (4) calendar days in the second season to be entitled to a pay increment.

Using only the actual time remunerated during the seasons (April to October), the employee completes 21 weeks and four (4) calendar days on Wednesday, August 28, 2002.

The employee's pay increment date is on Friday, August 29, 2002.

4.14 Progression over a barrier

Where the relevant collective agreement, pay plan or specific terms and conditions of employment provide for advancement over the barrier, in a range of rates, an employee so advanced retains the previously established pay increment date for the calculation of the pay increment period.

Example

A full-time employee in a represented DA-CON-01 position who is earning $29,220 per annum, which is the 7th step in the range, last received an increment effective on January 13, 2003.

Effective July 14, 2003, the employee is eligible to an increment to the 8th step in the DA-CON-01 pay rate scale.

The PA collective agreement states that the increment period for employees at DA-CON-1 level is 26 weeks up to and including the 8th step, and 52 weeks for the 9th and 10th steps in the salary range. The increment date is the Monday following the increment period.

To progress beyond the 8th step, the employee must meet specified standards of proficiency and performance.

Assuming the employee meets the above criteria, the employee's next pay increment date is effective on Monday, July 14, 2003. The subsequent pay increment is effective on the Monday following the pay increment period of 52 weeks, which is on Monday, July 12, 2004.

4.15 New maximum or restructure negotiated

During the past few years, some collective agreements negotiated an additional step in the pay rate scale, which represented a new maximum or pay restructure.

Refer to the relevant collective agreement, pay plan or specific terms and conditions of employment, for the pay increment date of an employee who had attained the maximum of the pay rate scale, prior to the signature of the new collective agreement. If the authority is silent, then the following applies.

The employee's next pay increment date is established:

  • From the last pay increment date; or
  • The latest date of appointment based on the promotion rule; or
  • As per the PSTCER 33.(1) to 39 for an appointment based on the deployment or transfer by appointment rule.

Example 1: CS-02 - new maximum

Prior to the new CS collective agreement signed June 3, 2003, a full-time employee in a represented CS-02 position who is earning $60,541 receives an increment to the maximum of the range, which is effective on September 11, 2002.

The new CS collective agreement is signed on June 3, 2003. This agreement revises the salary rates effective from May 1, 2002, June 22, 2002, and provides a restructure with a new salary maximum for the CS-02 level, which is effective on May 22, 2003.

The Pay Note 1.(a)(i) of the CS collective agreement specifies that employees at level CS-02 who have been at the maximum rate of pay for 12 months or more on May 22, 2003, will move to the new maximum rate of pay, effective on May 22, 2003.

In this example, the CS-02 employee does not meet the Pay Note criteria and therefore, the employee's new increment date will be calculated from the employee's last increment date, which is on September 11, 2002.

The pay increment period for the CS-02 is 12 months and the increment date is the anniversary date. The employee's next increment date is effective on Thursday, September 11, 2003.

 

Example 2: Appointed to a lower maximum - new maximum

Prior to the new CS collective agreement signed June 3, 2003, a full-time employee in a represented CS-03 position who is earning $64,130 receives an increment to the 3rd step, which is effective on January 24, 2003.

The employee was appointed to a lower maximum position, as a CS-02, which is effective on February 4, 2003.

As per the Deployment or transfer by appointment module the employee's salary on appointment is the rate of pay that is nearest to but not less than the rate of pay the employee was entitled to in the previous position immediately before the deployment or the transfer by appointment. Or, if there is no such rate, rate of pay would be at the maximum for the position to which the employee is deployed or appointed.

Effective on February 4, 2003, the employee's salary in the CS-02 position is $60,541, the maximum of the level.

The new CS collective agreement is signed on June 3, 2003. This agreement revises the salary rates effective from May 1, 2002, June 22, 2002, and provides a restructure with a new maximum salary for the CS-02 level, which is effective on May 22, 2003.

The Pay Note 1.(a)(i) of the CS collective agreement specifies that employees at level CS-02 who have been at the maximum rate of pay for 12 months or more on May 22, 2003, will move to the new maximum rate of pay, effective on May 22, 2003.

In this example, the CS-02 employee does not meet the Pay Note criteria, and therefore, the employee's new increment date to the new maximum will be calculated from the employee's last increment date of January 24, 2003, as per the PSTCER 33.(1).

The pay increment period for the CS-02 is 12 months and the increment date is the anniversary date. The employee's next increment date is effective on Saturday, January 24, 2004.

 

Example 3: CS-01 level, 6th step

Prior to the new CS collective agreement signed June 3, 2003, a full-time employee in a represented CS-01 position who is earning $37,703 receives an increment to the 6th step of the salary range, which is effective on April 14, 2003.

The new CS collective agreement is signed June 3, 2003. This agreement revises the salary rates effective from May 1, 2002, June 22, 2002, and provides a restructure with a new salary maximum for the CS-01 level and removes steps 1 through 7. The changes are effective on May 22, 2003.

Since the Pay Note 1.(a)(ii) is not applicable to employees who were at steps 1 to 7 on May 21, 2003, the employee's next increment date will be calculated from the employee's last increment date, which is on April 14, 2003.

The pay increment period for the CS-01 is 12 months and the increment date is the anniversary date. The employee's next increment date is effective on Wednesday, April 14, 2004.

 

Example 4: CS-01 level, at the 8th step on May 21, 2003, with more than 6 months

Prior to the new CS collective agreement signed June 3, 2003, a full-time employee in a represented CS-01 position who is earning $40,773 receives an increment to the 8th step, which is effective on November 18, 2002.

The new CS collective agreement is signed June 3, 2003. This agreement revises the salary rates effective from May 1, 2002, June 22, 2002, and provides a restructure effective May 22, 2003, with a new salary maximum for the CS-01 level and removes steps 1 through 7. The changes are effective on May 22, 2003.

The Pay Note 1.(a)(ii) of the CS collective agreement specifies that employees who were at the 8th step of the pay range for six (6) months or more on May 21, 2003, will move to the next step, which is now the new 2nd step of the CS-01 pay range, which is effective on May 22, 2003.

The employee's new salary on May 22, 2003, is $44,009, and as per the Pay Note 1.(a)(ii), a new pay increment date will be established effective on May 22, 2003.

The pay increment period for the CS-01 is 12 months and the increment date is the anniversary date. The employee's next increment date is forecasted for Saturday, May 22, 2004.

 

Example 5: CS-01 level, at the 8th step on May 21, 2003, with less than 6 months

Prior to the new CS collective agreement signed on June 3, 2003, a full-time employee in a represented CS-01 position who is earning $40,773 receives an increment to the 8th step, which is effective on November 25, 2002.

The new CS collective agreement is signed on June 3, 2003. This agreement revises the salary rates effective from May 1, 2002, June 22, 2002, and provides a restructure with a new salary maximum for the CS-01 level and removes steps 1 through 7. The changes are effective on May 22, 2003.

The Pay Note 1.(a)(ii) of the CS collective agreement specifies that employees who were at the 8th step of the pay range for six (6) months or more on May 21, 2003, will move to the next step, which is now the new 2nd step of the CS-01 pay range, which is effective on May 22, 2003.

In this example, the CS-01 employee does not meet the Pay Note criteria and therefore, the employee's new increment date will be calculated from the employee's last increment date, which is on November 25, 2002, and the salary on May 22, 2003, will be the minimum, $42,410.

The pay increment period for the CS-01 is 12 months and the increment date is the anniversary date. The employee's next increment date is effective on Tuesday, November 25, 2003.

4.17 Specified period appointments

Refer to Example 2 of Section 12 of the Specified period appointments during extended periods of leave without pay (dual employment) chapter and the unrevised section of the Pay Administration Guide on Part-time, casual and seasonal employees.

4.18 Work force adjustment

Employees identified as being surplus to operational requirements, continue to receive pay increments as outlined in the various sections of this module.
