1. Terms and definitions

The following words and phrases used in this section have the same meaning as the ones in the Glossary of terms and definitions found under the Compensation and Pay Administration heading. In order to ensure consistency and accuracy in terminology, the user may click on any of these terms for the definition.

Should an employee terminate employment and have a break in service, another probationary period is established for the new or subsequent appointment from outside the Public Service.

2. Salary on deployment or transfer by appointment (PSTCER 26.(1)(2)) (beyond the probationary period (PSEA 28))

On a deployment or transfer by appointment beyond the probationary period, the employee is entitled to receive the rate of pay that is nearest to but not less than the rate of pay received immediately before the deployment or transfer by appointment, or if there is no such rate, the maximum rate of pay for the new position.

Former employees are not to be paid retroactivity on promotion (for example, due to a competitive process or a classification decision), unless the certificate of appointment is authorized prior to the effective date of the termination of employment.

Retroactive promotion of a former employee

As a result of a classification decision, a position is reclassified from an ST-SCY-03 to a CR-04, which is effective on April 1, 2003. The TB 330-167 classification document is dated July 22, 2003, and the letter advising the former employee of the classification decision is dated July 30, 2003.

The incumbent of the position resigned and was struck-off strength (SOS), and the effective date was on Saturday, May 31, 2003.

The certificate of appointment in this example is the letter advising the employee of the classification decision, which is dated after the SOS date of May 31, 2003. The former employee is not entitled to the retroactive payment for the period from April 1, 2003, to May 30, 2003.

When performing calculations where there is a difference in the authorized salary, convert the salaries to the basis of the new group and level prior to the calculation.

Annual salary to hourly salary

Deployed or transferred by appointment from a classification with authorized annual rates of pay to a classification with rates of pay authorized on an hourly basis.

Convert the annual rate to an hourly rate for calculation purposes.

For example, divide the annual rate by 1956.6 for a 37.50 hours scheduled work week, or 2087.04 for a 40 hours scheduled work week.

 

Hourly salary to annual salary

Deployed or transferred by appointment from a classification with authorized hourly rates of pay to a classification with rates of pay authorized on an annual basis.

Convert the hourly rate to an annual rate for calculation purposes.

For example, multiply the hourly rate by 1956.6 for a 37.50 hours scheduled work week, or 2087.04 for a 40 hours scheduled work week.

2.1 Procedures

Determine the lowest pay increment of the position to which the person is appointed. For a position where there is only a minimum and a maximum rate of pay, the lowest pay increment is predetermined within the pay notes of the relevant collective agreement.

Determine the difference between the maximums of the two positions.

If the difference between the maximums of the positions is less than the lowest pay increment of the new position when it has more than one rate of pay, or less then four per cent (4%) of the maximum rate of pay for the position held by the employee immediately prior to that appointment, where the position to which the employee is appointed has only one rate of pay, the appointment constitutes a deployment or transfer by appointment.

Select the rate of pay for that position, which is nearest to but not less than the rate currently received.

History

Prior to July 29, 1998, if one or both positions were subject to an equalization adjustment, the annual equalization amount was added to each of the rates of pay of the applicable position before applying the above procedures.

Note 1: If applicable, determine the employee's next pay increment date on deployment, or transfer by appointment. For more information, refer to the Pay increments module.

Note 2: Once the salary on appointment is established based on the substantive level and if acting pay is received immediately prior to the appointment, refer to the Acting assignments module.

Example 1: Deployment or transfer by appointment beyond the probationary period

A full-time employee in an ST-SCY-03 position who is earning $36,711 per annum is appointed to a CR-04 position, which is effective April 14, 2003. The employee's certificate of appointment is dated March 20, 2003.

  • Since the difference between the maximums is $585, which is less than the lowest pay increment of $962 of the CR-04, the appointment is a deployment or transfer by appointment. The employee is paid $37,421, which is the rate of pay nearest to but not less than the rate received previously.

The employee's salary on appointment, which is effective on April 14, 2003, is $37,421. This is the 2nd step of the CR-04 salary scale.

Example 2: Deployment or transfer by appointment beyond the probationary period

A full-time employee in a GS-STS-03 position in pay zone 1 who is earning $17.06 an hour is appointed to a CR-03 position, which is effective on March 10, 2003. The employee's certificate of appointment is dated February 20, 2003.

When performing calculations where there is a difference in the authorized salaries, convert the salaries to the basis of the new group and level prior to the calculation. The hourly rate of pay of the GS-STS-03 in pay zone 1 must be converted to an equivalent annual rate of pay.

The formula is as follows:

52.176 weeks x scheduled work week (SWW) x hourly rate of pay

Using the above formula, the equivalent annual salary for the GS-STS-03 in pay zone 1, is $35,604.90 (52.176 weeks x 40 hours per week x $17.06 hourly rate).

This annual rate of pay is regarded as a maximum when applying the deployment or transfer by appointment regulations to determine the annual rate in the new classification.

Calculation
  • GS-STS-03 in pay zone 1, annual rate of pay on March 10, 2003

  • The maximum rate of pay of the new position CR-03 ($35,490) is less than the maximum rate of pay of the GS-STS-03 ($35,604.90).
 
  • Since the new maximum is less than the employee's current salary, the appointment is a deployment or transfer by appointment. The employee is paid $35,490, which is the maximum rate of pay of the CR-03 since there is no other rate of pay nearest to but not less than the rate received previously

The employee's salary on appointment, which is effective on March 10, 2003, is $35,490. This is the maximum amount in the CR-03 salary scale.

3. Salary on deployment or transfer by appointment (PSTCER 26.(3)) (during the probationary period (PSEA 28))

This section describes the salary treatment when an employee deploys or transfers by appointment during the probationary period, and the rate of pay is that rate of pay, which would have been paid, had the employee not been appointed to the position from which the employee is being deployed or transferred by appointment (PSTCER 26(3)).

Note: Normal promotion rules apply where a promotion (not a deployment or transfer by appointment) occurs during an employee's probationary period.

The procedures from Section 2.1 above must also be applied in order to determine if the new appointment is a deployment or transfer by appointment or a promotion.

Once the relevant regulation is established, the following step should be taken.

Calculate the salary for the new appointment by selecting the salary for the position from which the employee would have been paid had the employee not been appointed to the position from which the employee is being deployed or transferred by appointment.

Example 1: Deployment or transfer by appointment during the probationary period

First position

A person is appointed from outside the Public Service to a ST-SCY-02 position who is earning $34,449, the minimum, which is effective on July 18, 2002. The full-time employee is subject to a probationary period, which ends July 17, 2003.

Second position

Effective January 24, 2003, the employee is promoted to a ST-SCY-03 position earning $35,689 (minimum) per annum.

Third position

Subsequently, the employee is appointed to a CR-04 position, which is effective on April 14, 2003. The employee's certificate of appointment is dated March 20, 2003.

  • Since the difference between the maximums is $585, which is less than the lowest pay increment of $962 of the CR-04 (third position), the appointment is a deployment or transfer by appointment.
 

The new appointment has been determined as being a deployment or transfer by appointment during the probationary period. Therefore, the salary of the new appointment (CR-04, third position) is determined by using the employee's classification in the first position, which was ST-SCY-02.

  • Difference between the maximums (CR-04 and ST-SCY-02)

$2,213 ($39,349 - $37,136)

  • Since the difference between the maximums is $2,213, which is greater than the lowest pay increment of $962 of the CR-04, the appointment is a promotion. The employee's rate of pay is determined by adding the lowest pay increment of the CR-04 to the ST-SCY-02 salary. The employee is paid $36,454, which is the rate of pay nearest to but not less than $35,411.

($34,449 + $962 = $35,411)

The employee's salary on appointment, which is effective on April 14, 2003, is $36,454. This is the minimum rate of the CR-04 pay rate scale.

Example 2: Deployment or transfer by appointment during the probationary period

First position

A person is appointed above the minimum, from outside the Public Service to a CR-04 position earning $37,421. This is the 2nd step and is effective on July 18, 2002. The employee is subject to a probationary period, which ends July 17, 2003.

Second position

Effective May 8, 2003, the full-time employee is appointed to a ST-SCY-03 position. The employee's certificate of appointment is dated April 14, 2003.

Due to unusual difficulties in filling the position with a properly qualified candidate, the manager is requesting that the employee be remunerated at the maximum of the ST-SCY-03 salary scale.

The new appointment has been determined as being a deployment or transfer by appointment, during the probationary period. Therefore, determining the salary of the new appointment (ST-SCY-03, second position) is considered an initial appointment from outside the Public Service.

Applying the pay above the minimum on appointment from outside the Public Service policy, the manager can offer a salary above the minimum since the appointment is a deployment or transfer by appointment during the probationary period of the employee.

The employee's salary on appointment, which is effective on May 8, 2003, is $38,764. This is the maximum rate of the ST-SCY-03 salary scale.
