Clarification to the Classification Grievance Procedure

To: Chiefs of Classification

In order to avoid misunderstanding and to clarify past interpretations regarding grievances related to both the classification of a position and job content, please take note of the following changes to Section IV-A, paragraph 5 of the Classification Grievance Procedure. In the case where an employee files a classification grievance within the specified time limits and the grievance is also based on the job content, the following process must be observed:

  • the employee and his/her representative will be informed that the classification grievance cannot proceed until the job content dispute has been resolved.

Following such resolution, if the content of the work description has changed:

  • a new classification decision will be issued, based on an evaluation of the new work description;
  • the employee will be officially informed of the evaluation results and the department will confirm with the grievor his/her intent to pursue the original classification grievance;
  • if the employee wishes to continue with his/her classification grievance, the grievance will be heard in accordance with the classification grievance procedure.

If the work description has not changed:

  • the initial classification decision rendered will remain valid and a new classification decision need not be issued. If the employee wishes to continue with his/her initial classification grievance, the grievance will be heard in accordance with the classification grievance procedure.
