Appendix D

Memorandum of Agreement Applicable to Certain Employees in the General Technical Group, Working on Rotating or Irregular Basis (Coast Guard Marine Search and Rescue (SAR) Controllers of the Rescue Coordination Centres and Marine Rescue Sub-Centres and Hovercraft Personnel)

The provisions of this Collective Agreement, with the amendments noted below, shall apply to Coast Guard Marine Search and Rescue (SAR) controllers of the Rescue Coordination Centres and Marine Rescue Sub-Centres and hovercraft personnel working on a rotating or irregular basis.

Article 25
Hours of Work

  1. Delete clause 25.09 except 25.09(c) and add the following:

    • 25.09
      For employees who work on a rotating or irregular basis, the normal hours of work of thirty seven decimal five (37.5) hours per week and seven decimal five (7.5) hours per day may be arranged so that employees are scheduled:
      1. to work an average of thirty-seven decimal five (37.5) hours per week;
      2. to work over a period not exceeding sixty-three (63) days;
      3. to work shifts of twelve (12) hours duration (except as may be otherwise agreed), where a shift is defined as the continuous duration of time between the employee's scheduled start time and the scheduled stop time;
      4. notwithstanding the provisions of this Article, it may be operationally advantageous to implement changes to the duration of a shift from those currently in place. Any such change may be advanced by either party and must be mutually agreed between the Employer and the majority of employees affected;
      5. to work, subject to operational requirements, consecutive shifts of not more than four (4) twelve (12) hours shifts where twelve (12) hour shifts are in place;
      6. to obtain an average of two (2) days of rest per week.
  2. The Employer will make every reasonable effort:
    1. to avoid excessive fluctuations;
    2. to provide at least two (2) consecutive days of rest, except when days of rest are separated by a designated paid holiday that is not worked;
    3. to consider the wishes of the majority of the employees concerned in the arrangement of shifts within a shift schedule;

    1. to have each schedule posted at least fourteen (14) days in advance of its starting date. If an employee is given less than seven (7) days advance notice of a change in his or her shift schedule, the employee will receive a premium rate of time and one-half (1 1/2) for work performed on the first shift changed. Subsequent shifts worked on the new schedule shall be paid for at the hourly rate of pay;
    2. to provide a meal break during the employee's full shift and, where operational requirements do not permit a meal break, the employee will remain at work and eat the meal on the job.

  1. Provided sufficient advance notice is given and with the approval of the Employer, employees may exchange shifts if there is no increase in cost to the Employer. Once an exchange of shifts has been approved, it will be the responsibility of the employees involved to report for duty in accordance with the approved exchange.
  2. Employees to whom this Memorandum applies shall be subject to clauses 25.10 to 25.13 of this Collective Agreement.
