Policy Objective

To provide for the corporate management of EX-4s and EX-5s (assistant deputy minister levels); the efficient and timely movement of executives to meet operational or individual needs; and a broader diversity of experience for all executive levels.

Policy statement

It is Government policy to deploy executives to meet operational needs; to fulfil the career development and individual needs of executives; to develop the skills and abilities required by organisations in the longer term; to provide opportunities for executives to obtain a broad diversity of experience and prepare for the future; and to foster the achievement of employment equity goals.

Authority

Deputy heads have authority to make all deployments in the EX Group within and into their organisations taking into consideration the general deployment directives and the policy provisions described below.

Application

This policy applies to all organisations listed in Part 1 of Schedule 1 of the Public Service Staff Relations Act for which the Treasury Board is the employer and where staffing is conducted in accordance with the Public Service Employment Act.

Policy guidelines

The provisions in the Public Service Employment Act (PSEA) on deployment, except for the provisions concerning the deployment recourse process, apply to the Executive (EX) Group. The definition of deployment as well as the conditions of deployment included in the PSEA apply to the EX Group as do the Treasury Board's policy objectives set out below for the corporate management of EX-4s and EX-5s (assistant deputy minister levels) for the use of this staffing mechanism.

Executive Employment Transition Policy (EETP)

Departmental EXs affected by the Executive Employment Transition (EET) policy shall be considered for internal deployment opportunities before a deployment of another executive from within or outside the department is made.

Before making an interdepartmental deployment, the deputy head shall consult the Public Service Commission which may bring to the deputy head's attention the names of EXs who are affected by the EET policy or who would benefit from an interdepartmental deployment. The Public Service Commission may also refer other EXs for consideration.

The Public Service Commission will provide information to departments on the procedures for the referral of EXs affected by the EET policy and on other candidate referral services available.

Corporate Management of Assistant Deputy Ministers

It is a term and condition of employment of all EX-4 and EX-5 positions that employees of these positions give their agreement to being deployed.

For greater certainty, this term and condition will apply:

  1. upon first appointment to positions at the EX-4 or EX-5 levels through the pre-qualification process for Assistant Deputy Ministers;
  2. upon appointment to positions at the EX-4 or EX-5 levels to or from within the Public Service through competitive or non-competitive processes;
  3. upon promotion from an EX-4 position to an EX-5 position;
  4. to EX-4 or EX-5 employees occupying existing positions as of June 18, 1997 who voluntarily opt to participate in the new regime after that date.

Existing EX-4 and EX-5 employees who do not opt to participate in the corporate management regime of the ADM Group will be exempted from meeting this term and condition of employment. This means that they will retain the right of consent to any offer of deployment for as long as they remain at their current group and level.

The Public Service Commission will provide information to departments on the procedures for the consideration by the Senior Personnel Advisory Committee (SPAC) of proposed deployment of EX-4s and EX-5s.

Policy requirements

Deputy heads shall incorporate agreement to being deployed as a term and condition of employment for all EX-4 and EX-5 positions into departmental policies and practices.

Deputy heads shall identify to the Public Service Commission those EX-4 and EX-5 employees who voluntarily opt to participate in the new regime and those who opt not to participate and are exempted from meeting the term and condition of employment.

Deputy heads shall ensure that new entrants to EX-4 or EX-5 positions or employees who, as of June 18, 1997, were in positions at the EX-4 or EX-5 level and who subsequently elected to participate in the corporate management regime are informed in writing of the implications related to deployments.

Deputy heads shall advise the SPAC of all proposed deployments of EX-4s and EX-5s.

Departments shall advise the Public Service Commission in a timely manner of all EX deployments made.

Departments are to keep and provide any statistics or information that the Treasury Board Secretariat may request from time to time.
