Rescinded [2018-05-29] - Guideline on Claims and Ex Gratia Payments

Assists managers and staff to increase the efficiency, expediency and timeliness for the settling and paying of claims by or against the Crown and against its employees, and for processing ex gratia payments.

Manager's Responsibilities

  1. When a claim is received the manager requests that the claimant provide documentation to support the claim;
  2. If a formal investigation is required, the Security Directorate conducts a formal investigation and prepares a report for the manager;
  3. If the manager determines a legal opinion is required, claim documentation (including the investigation report, if applicable) is sent to Legal Services;
  4. When Legal Services provides advice to settle the claim, the manager prepares a report recommending payment;
  5. If a legal opinion is not required and the manager decides to settle the claim, the manager prepares a report recommending payment; and
  6. The payment process is followed.
