Guidance on Preparing Information Sharing Agreements Involving Personal Information

8. Reference documents and useful links

Federal legislation and useful link:

[1] "Possible identification" means a "serious possibility." It should be something more than a frivolous chance, but less than a balance of probabilities.

[2] Note: remember, however, that the collection of this type of information by government institutions subject to the Act, must still satisfy the requirements of section 4 of the Privacy Act relative to collection.

[3] The use of personal information for research provisions may be subject to other legal requirements such as sections 38 and 39 of the Department of Human Resources and Skills Development Act or the Privacy Code of the Department of Social Development Act.

[4]   Other than sections 6, 7 and 8 of the Privacy Act, which deal with retention, disposition, accuracy, use, and disclosure, there is no specific provision in the Act that focuses on the protection of personal information.  Any protection offered to personal information is ancillary to the main objective of these sections and would apply where the government institution retains control of the personal information.
